Leg injuries – including broken bones, torn ligaments or tendons, muscle sprains and strains, and amputations – can be very painful, debilitating, and life-changing. Leg injuries often occur while on the job, especially for construction workers, factory and manufacturing workers, and police officers, paramedics and firefighters. If you suffered a leg injury while on the job, you are likely entitled to workers’ compensation benefits. Workers’ Compensation for Leg Injuries

If you suffer from a work-related leg injury, you may be eligible for workers’ compensation benefits. Workers’ compensation benefits are generally available for any accident or injury that occurs while on the job, regardless of who was at fault for the accident. Under Illinois Workers’ Compensation Act, injured workers can recover the following worker’s compensation benefits after for a work-related injury, depending on the type and severity of the injury:

  1. Medical expenses
  2. Temporary total disability (TTD) benefits equal to two-thirds of your average gross weekly wage, up to a weekly maximum payment
  3. Permanent total disability (PTD) or permanent partial disability (PPD) benefits, which are often paid as lump-sum payments
  4. Vocational rehabilitation benefits

Other Legal Claims for Leg Injuries

While workers’ compensation laws prevent an injured employee for suing his or her employer for work-related leg injuries, a third-party claim may be brought against a third-party if the injury was caused or exacerbated by the negligence or misconduct of that party. For instance, if a leg injury is exacerbated by medical malpractice that occurred while the employee was getting medical treatment after a workplace accident, the doctor or hospital may be liable for additional compensation. Similarly, if the leg injury was the result of a slip and fall accident on someone else’s property while performing job-related functions, the injured worker may be able to pursue legal action against the negligent property owner.

Whereas workers’ compensation benefits are determined according to the injured worker’s salary, personal injury compensation is determined based on the extent of injuries and damages suffered. Compensatory damages cover medical expenses, lost income (past and future), loss of normal life, and pain and suffering. In some cases, punitive damages might also be available.
