By Donald W. Fohrman
28 Apr, 2020
On April 13, 2020, the Illinois Workers’ Compensation Commission (IWCC) enacted an emergency rule which is designed to protect essential employees should they become ill with COVID 19. The rule creates a “rebuttable presumption” that if an essential employee contracts COVID 19, the contraction occurred during-the-course of his or her employment.

Workplace Safety: Preventing Falls

By Donald W. Fohrman

Falls account for a significant portion of workplace injuries. They occur in office buildings, retail stores, warehouses, in hospitals and on construction sites. No occupation is immune or safe from falls. Falls cover a diverse range of injuries including slips, trips, and drops from several stories. Most falls are nonfatal and not serious but, especially in construction, they constitute a significant portion of overall worker accidents. As a result, enormous energy, money and time are spent to curb the number of falls American workers experience.

Pedestrian safety is a growing concern in big cities around the country. A recent report from the National Highway Traffic Safety Administration (NHTSA) indicates a 10 percent increase in pedestrian fatalities from car accidents since 2014. The report is published annually and shows data collected from all 50 states. Data collected in 2015 shows the largest year-to-year increase in pedestrian injuries and fatalities since national record keeping began in 1975. Increased pedestrian injuries in Chicago have created an urgent need for Illinois car accident lawyers who can provide important legal advice.

Are telecommuting employees covered by workers’ compensation in Illinois?

By Donald W. Fohrman
11 May, 2016
Several organizations have identified American workers' preference to work a job with some telework, but this arrangement can lead to complications. Employers benefit from such arrangements by having to pay less overhead to support the practice and having improved employee morale. Employees value the flexibility and added time by not having to commute to work. According to Global Workplace Analytics, approximately 25 percent of the workforce teleworks at some frequency but many more would like similar arrangements. When workers are injured while not at the actual job site, they may be confused about their rights and whether such an injury is covered.
