Chicago, Ill. February 29th, 2016 Jurors have concluded that Johnson & Johnson was responsible for a woman's death from ovarian cancer. This death is believed to have been brought about by the victim's previous use of a talc-based Johnson & Johnson product. Not only has the talc-based product been linked to ovarian cancer, Johnson & Johnson is believed to have known of the cancer risks associated with its products -- and still failed to notify consumers. This failure will ultimately prove an expensive one for Johnson & Johnson, which is now required to shell out $72 million in compensatory and punitive damages.

This is a valid concern because the negligent party or their insurance company will likely try to use that information against the injured party to settle for lesser damages or nothing at all. However, the existence of a pre-existing injury does not automatically mean that the injured party cannot seek compensation for their current personal injury claim. This holds true even if the previous injury has been aggravated by the new incident.

A dog is man's best friend. It's an often repeated line that isn't always true. The reality is that dogs are animals, and they will behave and react in ways that are not always predictable. Even the smallest dog can pack a serious bite that can cause real damage. When an individual chooses to own a dog, they are also choosing to accept the liability that comes with that decision. Fortunately, there are remedies available for individuals who find themselves suffering from Fido's actions.
