Workplace Nerve Damage Injuries

Chicago Workers’ Compensation Lawyers

Nerve damage is a common workplace injury that often occurs as a result of machinery accidents, work-related auto accidents, lifting injuries, slip and fall accidents, or repetitive stress trauma. When the nerve damage is caused by the compression or stretching of the nerve tissues, rehabilitation and recovery may be possible. But if the nerve damage is caused by a severing of the nerve tissues, the injury is often permanent since little can be done to repair a severed nerve.

Types of Work-Related Nerve and Tendon Injuries

Workers’ Compensation for Nerve Damage Injuries

If suffer from a work-related nerve damage, you may be eligible for workers’ compensation benefits. Workers’ compensation benefits are generally available for any accident or injury that occurs while on the job, regardless of who was at fault for the accident. Under Illinois Workers’ Compensation Act, injured workers can recover the following worker’s compensation benefits after for a work-related injury, depending on the type and severity of the injury:

  1. Medical expenses
  2. Temporary total disability (TTD) benefits equal to two-thirds of your average gross weekly wage, up to a weekly maximum payment

  4. Vocational rehabilitation benefits

Other Legal Claims for Nerve Damage

While workers’ compensation laws prevent an injured employee for suing his or her employer for work-related nerve damage, a third-party claim may be brought against a third-party if the injury was caused or exacerbated by the negligence or misconduct of that party. For instance, if nerve damage is exacerbated by medical malpractice that occurred while the employee was getting medical treatment after a workplace accident, the doctor or hospital may be liable for additional compensation. Similarly, if the nerve damage or other injury was the result of an auto accident that occurred while on the job, the negligent motorist could be liable in a personal injury lawsuit.

Whereas workers’ compensation benefits are determined according to the injured worker’s salary, personal injury compensation is determined based on the extent of injuries and damages suffered. Compensatory damages cover medical expenses, lost income (past and future), loss of normal life, and pain and suffering. In some cases, punitive damages might also be available. Punitive damages are meant to punish the negligent party for his or her wrongdoing, and deter future grossly negligent or intentional wrongdoing.
