REDUCED ATTORNEYS FEES

During these tough economic times, many people are struggling to make ends meet.   Our firm has decided that during this time, we will reduce our attorney’s fees on all Workers’ Compensation claims from 20% to 17-1/2% and on all types of Personal Injury cases from 33% to 30%.

While we want people to know that we are reducing our fees, we also want to make them aware that we will provide the same high level of service and achieve the same high level of success that we have over the past 38 years in representing injury victims.

Reducing our attorney’s fees is just a small gesture, but one that we hope puts a little more money back in the pockets of the people who need it most.  (More)

Overtime Wage Claims

The Fair Labor Standards Act (FLSA) requires employers pay to non-exempt employees overtime pay at the rate of one and one half times (1 ½) their regular rate of pay if the employee works more than 40 hours in a work week.  Most employees qualify to receive overtime pay with a few exceptions.

However, some employers ignore the laws under the FLSA and do not pay their workers overtime pay:

  • Your employer might be violating the law by telling you that you are not entitled to overtime because you are a salaried employee.  Unless your description falls under one of the exemptions categories, you may still be entitled to overtime.

  • Salary deductions in increments of less than one full day's worth of pay are almost always not allowed under the FLSA and could entitle the salaried employee to overtime.

  • As a salaried employee if you are paid less than $455, you would be entitled to overtime pay no matter what your job responsibilities may be.

  • Your employer may also try to avoid paying overtime if you are paid on a bi-weekly basis by paying overtime after 80 hours.  This is also a violation of the FLSA.  It does not matter that you are paid bi-weekly.  If you work more than 40 hours in a work-week during the pay period, you are entitled to overtime.

Some states have their own laws concerning overtime and minimum wage claims.  Under these laws you may be entitled to overtime that is calculated at higher rates than the FLSA.

Special rules apply to employees of federal, state and local governments in the areas of fire protection and law enforcement, volunteering and compensatory time.  A limited partial overtime exemption applies to law enforcement and fire protection employees. [more]
